ediation and Dispute Resolution
Mediation Service
Mediation is a form of alternative dispute resolution that involves a neutral third party who facilitates communication and negotiation between parties in a dispute in order to reach a mutually acceptable agreement. It can offer a more cost-effective and efficient alternative to litigation.
Mediation may be required through a dispute resolution clause under contract or where a Court mandates mediation prior to an actual Court proceeding taking place.
Building disputes can arise from disagreements over contract terms, payment disputes, delays, defective workmanship, and breaches of contractual obligations.
The benefits of mediation:
- Cost: Mediation avoids the high costs associated with litigation.
- Time: Mediation can typically be completed in a shorter timeframe compared to court proceedings.
- Confidentiality: Mediation sessions are confidential, ensuring that sensitive information remains private.
- Relationships: Mediation focuses on open communication and mutually acceptable solutions, which can help preserve relationships between parties.
- Empowerment and control: Mediation allows the parties to have control over the outcome and provides an opportunity for creative and flexible solutions.
At CJK, we offer the services of an accredited mediator, who is formally trained, experienced and has a strong technical and special expert background.
